How to Claim Lost Wages from a Car Accident in New York

New York State operates under a No-Fault insurance system, which means that if you’re injured in a motor vehicle accident, you’re entitled to seek benefits from your own insurance provider—regardless of who was at fault. If your injuries prevent you from working, No-Fault also provides monetary compensation for your lost wages, helping to ease financial stress during your recovery.

Understanding Your Benefits

Lost Wages Compensation: No-Fault coverage reimburses 80% of your gross earnings, up to a maximum of $2,000 per month, for up to three years following the accident. The best part? These payments are tax-free when you file your returns.

Short-Term Disability Benefits: In addition to No-Fault, you may also be eligible for New York State Disability benefits through your employer’s disability insurance carrier. By law, employers must provide short-term disability benefits, which cover 50% of your average weekly wage, up to $170 per week, for a maximum of 26 weeks. Be sure to apply for these benefits—otherwise, your No-Fault carrier may deduct them from your wage loss payments.

Navigating the Claims Process

We understand that dealing with insurance forms can be overwhelming—especially while recovering from an accident. That’s why we’re here to help, guiding you through every step of the process to ensure you receive the benefits you’re entitled to.

Employer Wage Verification Form (NF-6 Form): Your employer must complete and submit this form to verify your employment status, pay rate, and work schedule. This verification is necessary before any payments can be issued.

For the Self-Employed: If you’re self-employed, you’ll need to verify your income through a Self-Employment Verification form. Your insurance company may also require copies of your tax returns to confirm your earnings.

Disability Letters: To qualify for lost wage benefits, you’ll need a letter from your treating physician confirming that your injuries prevent you from working. This letter must be updated every 30 days to maintain your eligibility.

Short-Term Disability & No-Fault: In New York, employers are required to provide short-term disability benefits for injuries or illnesses that occur off the job. Your employer should provide the New York State Disability Benefits Claim form (DB-450) to complete. Short-term disability provides 50% of your pay (up to $170 per week) for up to twenty-six (26) weeks. Should your disability extend beyond this period, No-Fault will require you to apply for Social Security Disability benefits.

Reimbursement for Sick/Vacation Time: If you use your accumulated sick time or vacation time while you recover from the car accident, you can still recover no-fault lost wages. You will be reimbursed for the accumulated sick or vacation time you used.
