At Greenstein & Milbauer, LLP, our attorneys have experience representing parents of babies born with injuries resulting from medical negligence before, during and after giving birth. Our personal injury trial attorneys are ready to help you fight for the full amount of financial damages your family will need for the care and treatment of your child — potentially a lifetime of care.
Typical causes of fetal trauma resulting in birth injuries include:
- Medication errors: Some medications prescribed during pregnancy carry a risk of injury to a fetus. If you were prescribed a medication that you think may have caused abnormalities in fetal development, or a physical or development disability in your child, your doctor may not have been aware of the harmful side effects.
- Palsy: Erb's palsy and cerebral palsy are neurological disorders resulting from injury to an area of the brain that affects muscle development and control. When a baby's brain is deprived of oxygen during the birth process, Erb's or cerebral palsy may result. The attending medical staff in the delivery room are specially trained to do everything possible to ensure the baby's oxygen supply throughout the birth process.
- Bone fractures: During the birth of large babies, doctors often use forceps to extract the baby from the birth canal. Forceps injuries can include shoulder dystocia, damage to bones in the face, neck, shoulders and back. In cases involving severe injuries, the facial structure can be permanently damaged.
- Asphyxiation: Anytime a baby is deprived of oxygen during birth, serious damage can result beyond Erb's or cerebral palsy. A cutoff of oxygen for several minutes can result in injuries to the brain, kidneys and lungs. In severe cases, asphyxiation can result in death.
Generally, there is a two-and-a-half year time limit to file a medical malpractice claim in New York. Time limits may be extended under certain conditions.
